What is Considered a Trademark Under the Law?
A trademark is a word, phrase, symbol, or design that identifies and distinguishes the source of one company’s goods from those of others. Symbols, designs, catchphrases, words, or combinations may be trademarked. Trademarks can be registered with the United States Patent and Trademark Office (USPTO).
There are many benefits to registering a trademark, including:
- The trademark becomes a valuable asset to the company
- It gives the owner exclusive rights to use the mark nationwide
- It puts the public on notice that the company owns the mark
- It helps to prevent others from using a similar mark and causing confusion in the marketplace
- It provides for substantial damages against those who infringe on the trademark

How Long is a Trademark Registration Valid?
A Michigan state-level trademark registration is valid for 10 years. However, before the 10-year registration expires, businesses can renew it for subsequent 10-year periods. Six months before the registration expires, the Michigan Department of Licensing and Regulatory Affairs (LARA) will send a renewal application to the original applicant. The applicant must renew the application before the trademark expires.
A federal trademark also needs to be maintained, and renewals must be filed in a timely manner.
If the trademark owner fails to renew their registration before the deadline, the mark will be considered abandoned. Once a trademark is abandoned, another business or entity can use it for its own purposes.
Our law firm understands that you are busy growing your business and can help you stay current with the trademark renewal process.
